Recent HUD Occupancy News

In November 2015, HUD issued HSG Notice 2015-10 Guidance for Public Housing Agencies (PHAs) and Owners of Federally-Assisted Housing on Excluding the Use of Arrest Records in Housing Decisions. 

This followed earlier changes that impacted criminal activity policies such as the memo from Deputy Assistant Secretary (DAS) Ben Metcalf regarding the use of marijuana in multifamily properties, the Supreme Court decision in regards to disparate impact and fair housing and Deputy Assistance Secretary (DAS) Ben Metcalf released a memo entitled, Occupancy Protections for HUD-assisted Households in Properties with Low-Income Housing Tax Credits which discussed termination in response to a residents participation in certain criminal activity.  When developing or updating policies addressing criminal activity, we have to consider this new guidance, plus previously issued guidance included in HUD Handbook 4350.3 R1, C4 and Housing Notices such as HUD Notice 2002-22 - Screening and Eviction for Drug Abuse and Other Criminal Activity - Final Rule, HUD Notice 2012-11 State Registered Lifetime Sex Offenders in Federally Assisted Housing.

HUD Releases New Notice Explaining Equal Access to HUDís Housing Programs Regardless of Sexual Orientation, Marital Status or Gender Identity:  HUD recently released Housing Notice 2015-06 Program Eligibility in Multifamily Assisted and Insured Housing Programs in Accordance with HUDís Equal Access Rule This Notice provides additional guidance addressing protections in place to ensure equal access to housing opportunities regardless of sexual orientation, gender identity or marital status.

HUD Releases Notice Explaining Methodology for Completing a Multifamily Housing Utility Analysis: At the end of June 2015, HUD released Housing Notice 2015-04 Ė Methodology for Completing a Multifamily Housing Utility Analysis.  This Notice can be found on HUDClips (Click Here)  Deputy Assistance Secretary (DAS) of Multifamily Housing Programs Ben Metcalfe has released a memo providing additional guidance.  The DAS Memo can be found on HUDís web site (Click Here)  This notice builds on a previous memo issued by former Deputy Assistant Secretary for Multifamily Housing Programs Carol J. Galante.

New Notice about REAC Inspections: HUD recently released Notice H2015-02 Required Actions for Multifamily Housing Projects Receiving Failing Scores from HUDís Real Estate Assessment Center (REAC)  This Notice discusses new rules and procedures for properties that receive a score of less than 60 on a REAC inspection.  HUD explains many of the procedures that are already in place at the Multifamily Housing Field Offices.  HUD also explains enforcement procedures to be used when a property experiences a ďSecond Consecutive REAC FailĒ.
