New Section 8 PBCA Awards Announced & Challenged

As many of you know, the Performance-based Contract Administrator contracts are expiring and new proposals were requested by HUD.  HUD accepted proposals for each state and conducted extensive analysis to determine who would perform Section 8 contract administration duties. 

HUD received one hundred fifty applications for fifty-three contracts.  Most states received two or more applications.  Only ten states/contracts had no competition.  HUD announced that twenty-eight states/territories will see a change in contract administrators because of the rebid. We have been fielding quite a few questions, so we wanted to provide you with a summary of the current status, as we understand it.

Some of you have been notified that the PBCA contract remains with the current PBCA.  Currently, there is no change and no challenge to the PBCA Awards for the following states:

  • Arkansas
  • Idaho
  • Iowa
  • Maine
  • Minnesota
  • Montana
  • Nebraska
  • New Hampshire
  • North Dakota
  • Oklahoma
  • Puerto Rico
  • South Dakota
  • Vermont
  • Wyoming

HUD has awarded the PBCA contracts to new contract administrators in the following states.  The current transition plan is for the PBCA responsibilities to “change hands” no later than September 30, 2011.

  • Alaska
    • Currently AKHA
    • New Award - Contract Management Services (CMS) – formerly Bremerton
  • Colorado
    • Currently CHFA
    • New Award – Southwest Housing Compliance Corporation
  • Hawaii
    • Currently CMS Contract Management Services (Bremerton)
    • New Award – Idaho Housing & Finance Association
  • Louisiana
    • Currently LA Housing
    • New Award – Southwest Housing Compliance Corporation
  • Nevada
    • Currently NV Housing
    • New Award – LA LOMOD/CMS Contract Management Services (Bremerton)
  • Utah
    • Currently CMS Contract Management Services (Bremerton)
    • New Award – Idaho Housing & Finance Association
  • Washington
    • Currently CMS Contract Management Services (Bremerton)
    • New Award – Wisconsin Housing & Economic Development/Quadel/ICAP

For the states listed above, the transition of the PBCA responsibilities from one PBCA to another will be conducted in accordance with the current Transition Guidance provided by HUD.  The PBCA Transition Guidebook is now online and may be accessed from HUD’s web site at:  http://portal.hud.gov/hudportal/documents/huddoc?id=pbcatransitionguide.pdf.  

In these states, owners can expect the new PBCA to follow the timeframes outlined below:

  • August 15 (day 45 of the 90 day transition) was to be the date of 1199A information requests by incoming PBCA’s from owners.
  • August 31 (day 61 of 90) was to be the cut-off date for management/occupancy reviews.
  • Sept 20 (Day 81 of 90) was to be the cut-off for rent adjustments and contract renewals, and for voucher processing.
  • Sept 29 (day 90 of 90) was to be the cut-off for new EH&S follow-up; and for resident concern/complaints.

Regarding adjustment of Rents and HAP contracts, the current PBCA is expected to diligently continue processing all actions (including issuing approval letters and rent schedules) up to the actual cut-over date, with the noted exception of new packages received within the final 10 days of the current contract. All appeals of rent adjustments, rent comparability studies or contract renewal not completed by the September 30 are to be forwarded to the local HUD office for review.

Considering the significant changes announced by HUD, it is not surprising that some of the PBCA awards have been challenged.  At this point, the new PBCA contract for the following states has been awarded to the current PBCA, but the award has been challenged.

  • Alabama – Award remains with Jeffco, but that award has been challenged
  • Connecticut - Award remains with Jeffco, but that award has been challenged
  • Indiana - Award remains with Indiana Housing & Comm. Dev. Agency/Quadel, but that award has been challenged
  • Kentucky - Award remains with Kentucky Housing Corporation, but that award has been challenged
  • Mississippi - Award remains with Jeffco, but that award has been challenged
  • Missouri - Award remains with Missouri Housing Development Commission/EPS, but that award has been challenged
  • North Carolina - Award remains with North Carolina Housing Finance Agency/Quadel/ICAP, but that award has been challenged
  • Pennsylvania - Award remains with Pennsylvania Housing Finance Agency/PMAM, but that award has been challenged
  • South Carolina - Award remains with SC State Housing Finance & Dev Authority, but that award has been challenged
  • West Virginia - Award remains with WV Housing Development Fund, but that award has been challenged
  • Wisconsin - Award remains with Wisconsin Housing & Economic Dev Auth., but that award has been challenged

Owner/agents with Section 8 properties in the states listed above should continue “business as usual” unless notified by HUD or your contract administrator. 

HUD announced that the PBCA would change for the following states, but these changes have been challenged. 

  • Arizona – from AZ Department of Housing to Idaho Housing & Finance Association

This award has been challenged.  AZ Department of Housing will continue as the PBCA until further notice.

  • California (northern) – from California Affordable Housing Initiative (CAHI)/CGI to LA LOMOD/CMS

This award has been challenged.  LA LOMOD/CMS will continue as the PBCA for southern CA.  CAHI/CGI will continue as the PBCA for northern CA until further notice.

  • Delaware – from Delaware Housing to Jeffco

This award has been challenged.  Delaware Housing will continue as the PBCA until further notice.

  • D.C. –  from Assisted Housing Services Corporation/CGI to District of Columbia Housing Finance Agency/Quadel/ICAP

This award has been challenged.  Assisted Housing Services Corporation/CGI will continue as the PBCA until further notice.

  • Florida – from NTHDC/CGI to National Housing Compliance (GA HAP)/EPS

This award has been challenged.  NTHDC/CGI will continue as the PBCA until further notice.

  • Georgia – from National Housing Compliance (GA HAP)/EPS to NTHDC/CGI

This award has been challenged.  National Housing Compliance (GA HAP)/EPS will continue as the PBCA until further notice.

  • Illinois - from National Housing Compliance (GA HAP)/EPS to Illinois Housing Development Authority/Quadel

This award has been challenged.  National Housing Compliance (GA HAP) will continue as the PBCA until further notice.

  • Kansas – from KS Housing Resources Corp to Southwest Housing Compliance Corporation

This award has been challenged. KS Housing Resources Corp will continue as the PBCA until further notice.

  • Maryland –  from MD DHCD to Summit Multi-family Housing/MAM

This award has been challenged. MD DHCD will continue as the PBCA until further notice.

  • Massachusetts  - from Mass. Housing to Cambridge Housing Services/CGI

This award has been challenged. Mass. Housing will continue as the PBCA until further notice.

  • Michigan – from MSHDA/EPS to Quality Affordable Housing Services/CGI

This award has been challenged. MSHDA/EPS will continue as the PBCA until further notice.

  • New Jersey - from NJHFA to Summit Multi-family Housing/MAM 

This award has been challenged. NJHFA will continue as the PBCA until further notice.

  • New Mexico – from NMMFA to Southwest Housing Compliance Corporation

This award has been challenged. NMMFA will continue as the PBCA until further notice

  • New York from NYHFA/CGI to Summit Multi-family Housing/MAM 

This award has been challenged. NYHFA/CGI will continue as the PBCA until further notice.

  • Ohio – from Assisted Housing Services Corporation/CGI to Ohio Housing Finance Agency/Quadel

This award has been challenged.  Assisted Housing Services Corporation/CGI will continue as the PBCA until further notice.

  • Oregon from OHCS to CMS Contract Management Services (Bremerton)

This award has been challenged. OHCS will continue as the PBCA until further notice.

  • Rhode Island from RI Housing to Jeffco

This award has been challenged. RI Housing will continue as the PBCA until further notice.

  • Tennessee from THDA to Jeffco

This award has been challenged. THDA will continue as the PBCA until further notice.

  • Texas – from Southwest Housing Compliance Corporation to Lone Star Multi-family Housing/Quadel/ICAP

This award has been challenged. Southwest Housing will continue as the PBCA until further notice.

  • Virginia - from Jeffco to VA Dept. of Housing & Community Development/Quadel/ICAP

This award has been challenged.  Jeffco will continue as the PBCA until further notice.

Regardless of status of challenges, owners must remain vigilant in looking for and responding to communications from HUD, your current PBCA or any new PBCA.

Note:  Please keep in mind that there are two types of contract administrators:

1.     Performance-based Contract Administrators (PBCA) and

2.     Traditional Contract Administrators (TCA)
