To be used BEFORE implementation of HOTMA only if the owner/agent will implement Enforcement or Limited Enforcement of the Section 8 Asset Restrictions for existing residents when creating ARs and IRs after HOTMA is implemented. Section 8 owner/agents must address new HOTMA Section 8 Asset Restrictions. Pre-HOTMA, if an applicant has reached the top of the waiting list and a unit is available, but the applicant fails the S8 Asset Restriction test (Asset Cap/Real Property Rule) owner/agents may make a unit offer. This is true until the owner/agent implements HOTMA compliant software and the HOTMA TSP. If the owner/agent will implement Enforcement of the S8 Asset Restrictions or Limited Enforcement of the S8 Asset Restrictions, the owner/agent should let the applicant know that they will not be eligible for subsidy once HOTMA is implemented. If the owner/agent has established a “grace period” of up to six months, that “grace period” starts with the first AR or IR after HOTMA compliant site software is implemented. Once HOTMA compliant site software is implemented, owner/agents may not offer a unit to a S8 applicant family that fails the S8 Asset Restriction test.

This Notice is provided to residents who have reported an income change or a change to deductions, but the change to Adjusted Income is less than 10%. Owner/agents should not create an IR if the resident is reporting a change to income or deductions that results in an increase of less than 10% of Annual Adjusted Income. Owner/agents may develop a policy to opt out of creating IRs if the resident is reporting a change to income or deductions that results in a decrease of less than 10% of Annual Adjusted Income. While not required, it is a good idea to have written documentation in the file showing you notified the resident that no IR is required, after he/she reported the change. HOTMA Changes to IR requirements should not be implemented until HUD provides additional clarification and HOTMA compliant site software is available and implemented.

In many states, when issuing new leases, owner/agents must also include new attachments. Streamlined Certification for Fixed Income Families has been available for HUD’s MFH programs since 2019. This is not new with the implementation of HOTMA. This self-certification allows residents to disclose any and all income for family members. If an owner/agent has adopted Streamlined Certification for Fixed Income Families, owner/agents have the option of accepting self-certification for any income that is not fixed.

Self Certification Receipt of Required Documents at AR

Use this form to document that all required forms have been provided at AR. As of 9/1/2024, HUD has not provided the new 9887 Package or the new HUD FACT Sheet – How Your Rent is Determined. Once those forms are released, owner/agents will update the FACT Sheet but still distribute each year at AR. Once the new 9887 is released, owner/agents will be required to provide this document 1) when an applicant is at the top of the waiting list (eligibility interview), 2) when a new adult is added, 3) when a minor turns 18 and 4) if subsidy is terminated then reinstated. This form will not be required at each AR ONCE HUD RELEASES THE NEW 9887 – EXPECTED IN LATE 2023 OR EARLY 2024)

This Asset Self Certification can be used as a general questionnaire or on properties that have implemented Streamlined Verification of Assets. Use to gather information about the value of assets and income from assets. This form includes self-certification of assets disposed of for less than fair market value. This form is part of the applications and AR Questionnaire. This questionnaire does allow for owner/agents to use the Pre-HOTMA Asset Threshold ($5000) or HOTMA Asset Thresholds (2024=$$50,000/2025=$51,600) If implementing any HOTMA changes prior to implementation of HOTMA compliant site software, the tenant file must be noted. Per HH 4350.3 Paragraph 5-13, family self-certifications must be notarized or witnessed.

Use to gather information about the value of assets and income from assets. This form includes self-certification of assets disposed of for less than fair market value. This form is part of each application and part of the AR Questionnaire. This form has been updated for HOTMA and does not inquire about Retirement Accounts which are excluded under HOTMA. The form also asks about federal tax refunds and tax credits that will be used to reduce the cash value of Included Assets when HOTMA is implemented. If implementing any HOTMA changes prior to implementation of HOTMA compliant site software, the tenant file must be noted.
Self-certification No SSN HOTMA

Updated for HOTMA and/or TRACS 2.0.3.A Anytime a member cannot provide an SSN or adequate documentation to verify the SSN, owner/agents should advise the member of the requirements. This includes the new requirement for owner/agents to accept self-certification with accompanying documents. This form can be used to communicate HUD's rule. This is very important when a minor under the age of six is added to a household because the family has 90 days to provide the SSN and adequate documentation to verify the SSN. Failure to do so will result in termination of assistance for all programs except PRAC and termination of tenancy for the PRAC program. Per HH 4350.3 Paragraph 5-13, family self-certifications must be notarized or witnessed.
Self-certification Real Property

New Form To Be Implemented When HOTMA is Implemented. Section 8 only. Under HOTMA, Section 8 residents must disclose if they own Real Property Suitable for Occupancy that a Member Has a Right to Sell. If so, an applicant family is not eligible to receive Section 8 housing assistance. There are some exceptions. For owner/agents implement Total Non-enforcement of the Section 8 Asset Restrictions, this rule does not apply to existing assisted residents. If an owner/agent is implementing Enforcement or Limited Enforcement of the Section 8 Asset Restrictions, then this rule will apply to existing assisted residents. If a resident or applicant owns real property but feels they are exempt under the rules, this form can be used to obtain self-certification and other information about the exemption. Eligibility review based on the Section 8 Asset Restrictions (Asset Cap and ownership of Real Property) are mandatory at application. Owner/agents must decide whether or not to enforce these restrictions after move-in
TSP Sample Language HOTMA

New Form Implemented When owner/agents create HOTMA TSPs No Later Than 5/31/2024. If you don’t need a new TSP or new House Rules, but want to add pertinent language related to HOTMA changes (including the Asset Restrictions for Section 8 programs) or related to changes that will be introduced by TRACS version 2.0.3.A, this document may help you get started. Keep in mind that many HOTMA changes cannot be implemented before HOTMA compliant software is available and implemented. HOTMA TSPs are not to be implemented until owner/agents implement HOTMA compliant site software. Until such time, the Pre-HOTMA TSP must be used
Verification Assets Bank Account HOTMA

Updated for HOTMA and/or TRACS 2.0.3.A Use this form to request information about accounts and account balances directly from a bank. Owner/agents may use current statements to verify the cash value of bank accounts. That is the preferred method. Under HOTMA, sending a verification directly to the bank is done when the resident cannot provide adequate statements. With the implementation of HOTMA owner/agents are to use current balances for checking accounts rather than a six month average. If you implement any HOTMA changes before HOTMA compliant software is available, you must document the tenant file.
Verification Assets on Deposit HOTMA

Updated for HOTMA and/or TRACS 2.0.3.A Use this form to inquire about types of assets on deposit from any financial institute. This HOTMA version asks for a current balance for checking accounts and allows for exclusion of retirement accounts.
Verification Deduction Medical Over the Counter Products HOTMA

Updated for HOTMA and/or TRACS 2.0.3.A Use this form to verify that over-the-counter products are used to diagnose, prevent or treat a specific medical condition which is the new requirement under HOTMA. Costs of items used for general good health are not included when determining the Medical Expense Deduction. If you implement any HOTMA changes before HOTMA compliant software is available, you must document the tenant file.
