Consent Release General

HUD does not provide a “HUD approved” general release document. HUD Form 9887 and 9887A provide some provisions for release of information. This is a sample general release form. It should be edited to conform to your management company’s policy and procedure. It is STRONGLY recommended that you seek legal counsel before implementing this form. State laws must be considered.

Lease Addendum Live-in Aide S8

Live-in Aide Addendums are strongly recommended by HUD. Any new addendum must be approved by HUD before you begin using it. If you wish to implement a Live-in Aide Addendum, this version may assist you in developing your own version. This IS NOT a pre-approved addendum. You must obtain approval before implementing.

Lease Addendum Temporary Relocation For Rehab

This addendum is not required by HUD. This lease addendum was designed for use when a RAD resident is relocating (for rehab) to another unit under the same contract and when the resident is expected to return to the same unit in a short period of time. Instead of creating a new lease for the transfer to the temporary unit and then a new lease for the transfer back to the rehabbed unit, this addendum outlines changes in TTP, address, utilities, etc. This IS NOT a pre-approved addendum. You must obtain approval before implementing.

Lease Attachment Lead-based Paint Disclosure

If your property was constructed prior to 1978, and if the property has not been certified as Lead-based paint free and if you house any member under the age of six, you must provide a Lead-based Paint Disclosure as an attachment to the lease. This is a sample that can be used to assist in creating your own disclosure. This does not require HUD approval.

Notice App Plan Update New Preferences

Use this notice advise applicants (not residents) when the Tenant Selection Plan undergoes significant change. Owner/agents must advise applicants if the owner/agent or HUD adds preferences or when HUD changes eligibility requirements. This notice includes a response and requires applicants to notify owner/agents of their desire to remain on the waiting list.

Use this notice to applicants on the PRAC Waiting List advising them that the property is being converted to Section 8 PBRA RAD. This notice includes a required response but does not include new questions related to the HOTMA S8 Asset Restrictions. Notice Term Assist Missing Signatures

While residents are automatically eligible at RAD conversion, owner/agents are still required to collect required forms such as new leases, etc. Use this notice when a tenant will not respond to multiple inquiries, and the owner/agents must Terminate Tenancy.

Notice Termination Lease Non-Adverse Action

This Lease Termination Notice explains that the resident family’s lease is being terminated for a Non-Adverse Action and a new lease will be provided. For example, when converting from PRAC to PBRA RAD, the HUD Lease 90105C will be terminated and the HUD Lease 90105A (including required attachments) will be executed. This is NOT a termination notice. This Notice is only used when the owner/agent plans to continue providing housing and housing assistance under another contract type.

Use this form to post information or provide an electronic notification about your Section 504 Coordinator. You are required to assign a Section 504 Coordinator if you employ 15 or more people regardless of their locations or duties. See HH 4350.3 R1, Paragraph 2-29 for additional information.

Security EIV Owner Authorization

EIV Coordinators must receive written permission from property owners before attempting to establish EIV Coordinator access for any property. This memo is provided on owner letterhead. An owner/authorization letter must be available for review at HUD’s request.
DO NOT SEND THIS LETTER TO HUD UNLESS SPECIFICALLY ASKED TO DO SO. Failure to produce an owner authorization at MOR will result in a finding. In addition, EIV access will be terminated until such authorization can be produced.

Self Certification Receipt of Required Documents at RAD Conv

Use this form to document that all required forms have been provided when converting to PBRA RAD.

Self-certification No SSN (Pre-HOTMA)

Anytime a member cannot provide an SSN or adequate documentation to verify the SSN, owner/agents should advise the member of the requirements. This form can be used to communicate HUD's rule. This is very important when a minor under the age of six is added to a household because the family has 90 days to provide the SSN and adequate documentation to verify the SSN. Failure to do so will result in termination. Per HH 4350.3 Paragraph 5-13, family self-certifications must be notarized or witnessed. This Pre-HOTMA version calls for termination of tenancy when required SSNs are not produced.

Student Certification S8

Owner/agents are required to ask all adults if they are a student enrolled in an institute of higher education (full time or part time). If the answer is yes, student eligibility must be determined. The questionnaire is a tool created by the owner/agent. There is no HUD requirement to have a questionnaire. This form is for use on all HUD MFH Section 8 properties which have specific eligibility criteria.

TSP Request Elderly Preference

If your property does not have a senior designation and when you would like to give preference to seniors, you must request permission from HUD. This sample letter can be used to help create your own request for an elderly designation.

This TSP must be edited to accurately describe your property's tenant selection criteria. Please note that this document has been updated to comply with HOTMA requirements. HOTMA TSPs are not to be implemented until owner/agents implement HOTMA compliant site software. Until such time, the Pre-HOTMA TSP must be used.
