HUD Form 9887

In the past couple of months we have received repeated requests for instruction explaining how to properly complete the HUD-9887 – Document Package For Applicant's/Tenant's Consent. A majority of the questions we've received center on what information should be included in the boxes at the top of the form. 

The rules for completing HUD-9887 have been the same since 2007 and information was provided in HUD’s RHIIP ListServ #57.

In RHIIP ListServ #57 HUD's guidance is as follows: “the top portion of the form includes a box for the full name and address of the Owner/Agent. If there is a management agent, that name and address must be inserted; if there is no management agent, only the owners name and address must be inserted.”

The boxes should be completed as follows:

Left Box HUD-9887: HUD Office Requesting Release of Information (Owner should provide the full address of the HUD Field Office, Attention: Director, Multifamily Division.):

THIS IS THE INFORMATION FOR THE HUD OFFICE HANDLING THIS CONTRACT

Center Box HUD-9887: O/A Requesting Release of Information (Owner should provide the full name and address of the Owner.):

IF THE PROPERTY IS OWNER MANAGED, INCLUDE THE OWNER INFORMATION. IF THE PROPERTY IS FEE MANAGED, INCLUDE INFORMATION ABOUT THE AGENT.

Right Box HUD-9887: PHA requesting release of information (Owner should provide the full name and address of the PHA and the title of the director or administrator. If there is no PHA Owner or PHA contract administrator for this project, mark an X through this entire box.):

IF A PHA IS THE OWNER OR THE CONTRACT ADMINISTRATOR THEN ENTER THE PHA INFORMATION. IF THERE IS NO PHA USE X'S

HUD has clarified that even though the center box requests the owner information, using the management agent name, in lieu of the owner name, is appropriate.

Remember, the HUD-9887 must be signed by the owner/agent, by the HOH, co-HOH and spouse regardless of age and by any adult household members. If a resident turns 18 and has not signed the form HUD-9887, the owner must not use the EIV Income Reports until the form is signed.  

Owners must address, in their policies and procedures, notification requirements and time frames, for residents who turn 18, to sign the consent forms HUD-9887 and HUD-9887-A.  

If the resident fails to sign the consent form(s) the household is in non-compliance with their lease and assistance to, and the tenancy of, the household may be terminated.
