New Considerations for the HUD Affirmative Fair Housing Marketing Plan

Owner/agents who are responsible for property marketing and/or the creation, review and update of HUD’s Affirmative Fair Housing Marketing Plan should be aware of new recommendations provided by HUD’s Office of Fair Housing.

Office of Fair Housing and Equal Opportunity (FHEO) Guidance on Compliance with Title VI of the Civil Rights Act in Marketing and Application Processing at Subsidized Multifamily Properties

This document provides updated information about how owner/agents might advertise availability of housing assistance. Use of the internet including developing web sites and implementing online applications “can reduce disparities and promote equitable housing opportunity, especially given the ease of digital communication.” HUD also discusses advertising, opening/closing waiting lists and applicant screening.

HUD also provides an Implementation Sheet for HUD’s Title VI Guidance Regarding Marketing and Application Processing at Subsidized Multifamily Properties to assist owner/agents as they update marketing strategies.

If you review your property’s Affirmative Fair Housing Marketing Plan and find that no changes are required, be sure to be prepared to provide documentation to HUD or HUD’s contractors responsible for conducting HUD’s Management & Occupancy Review.
