HUD Handbook 4350.3 Rev-1 Change-4 “Occupancy Requirements of Subsidized Multifamily Housing Programs” is over 750 pages and has not been updated since 2013. Someday it will be and there is no doubt it should be. But who the heck wants to do that?! 

HOTMA first came on the scene in 2016. Since then, there have been myriad extensions to the implementation date and multiple revisions to the implementation requirements. The impact on policies, procedures, resident notices, forms, questionnaires, reporting requirements…etc. at the site level is, in a word, overwhelming! 

So, it should come as no surprise, one of the most daunting tasks related to the implementation of HOTMA has been the review and update of forms, policies, and checklists. 

RBD took a long, hard look at our FASTForms library and decided to “clean house.” In the last five months, we have reviewed, revised, deleted and added forms and policies to ensure compliance with all of HUD’s requirements once HOTMA is fully implemented. This includes creating some forms that we consider “transition forms” to be used until HOTMA compliant site software is available and implemented (e.g. Note to File explaining which HOTMA changes have been implemented now.) 

This is a full scope update and includes incorporating not only HOTMA changes, but changes related to the PBRA RAD program, changes addressing Housing Notices and memos and standardizing fair housing language related to Section 504, VAWA and Limited English Proficiency requirements. We have also added considerations related to the Equal Access Rule and the LGBTQ community. 

All policy templates and forms have also been standardized to make it easier for owner/agents to integrate forms and “mail merge” options available in site software or by using global mail merge tools. 

For those owner/agents who purchased HOTMA compliant TSPs and EIV policies since February of this year, you have received multiple updates from RBD at no charge, as HUD provided clarifications throughout 2024. There is no need for you to purchase an updated TSP or EIV Policy Template.
